He should be charged with illegally hunting if it was after 4:59,but notice they say "around 5:00"...sunset today was 4:29Notsure

Saw it on this evening nenews. Thought dogs tail was a deer. Hello identify your target! !!! No charges will be filed.

crazy end of hunting for 2011 was 4:52 pm last night.. i agree should be charged identify your target.

Suppose he had a doe permit too,kinda need one of them at least if your gonna shoot at anything that looks like a deer tail,lol...And im sure if it was him that got wacked by some dumb ***,it would be a more serious issue,make's me sick!

My buddies aunt was the one that got shot. I was told he was shooting a traditional ML and a ball, but couldn't get any details with the time. I also thought it was late to be shooting.

Well thank God for that,had it been one of mikes 300 gr hollow points...coulda got a little messy.
Trouble is with being a trooper there will be a limited investigation and he will be absolved of all responsibility.

Just heard on the news the case is already closed, been ruled as an accident. The trooper was Jon Bergeron.

If in fact the cop shot this woman at 5:00 PM he was hunting after the season closed, it ended 30 min after sunset which was about 4:50. If you are found with a loaded weapon after hours you are in deep doo doo.Bash1

agreed. It wasn't even 24hrs before it was brushed under the rug. I understand everyone makes mistakes but at the very least this guy should have his hunting privileges taken away. It's not like he would be able to hit a deer in the woods with open sights 30+ min after sunset anyways!

who shoots at tails anyway.i sure hope i am not in the same woods he is in..I have seen some big racks running away from me. i would never shot that shot... it is not ethical... just shows you what kind of hunter this guy is... shooting at tails

Sportsmen of New England, GOAL, and NRA members should all be united around a "no confidence" petition declaring this state trooper to be unfit to carry a weapon. This was supposed to be a well trained professional law enforcement officer. Not a trigger happy slob "hunter". This petition should be on the Governors desk by the end of the month. And in the meantime this trooper should be on suspention until an impartial investigation takes place.
State employees are not above the law!!

I saw this story on the news and was personally blown away (no pun intended) by the ending of the story. "There will be no charges filed, and there will be no investigation".
Now, none of us (that I know of) where there that night and I think we all have to admit that believing everything you hear on the news is not a good practice. When I heard the reporter refer to the gun as a "muzzleloaded shotgun", I took the rest of the details with a grain of salt.
Giving everyone the benefit of the doubt, the fact that the case was closed so quickly and the media themselves aren't outraged (because we all know how much they would LOVE to jump on this kind of story), I'm gonna stay naive and assume there are details we haven't heard and the true story does make this an honest accident. But it sure is hard to not wonder given the information (or lack of) that has been shared to this point. Notsure

Heard this and at least he owned up to it! This day and age surprised he didn't try to hide the crime. Got to give hom some credit for at least taking the responsibilty. I don't hunt but really surprised that a state cop would make that kind of mistake!

...and answers to the only questions that could possibly make this a true accident for anyone, not just a state trooper.
1. It wasn't after legal hours
2. He had seen a deer in that same area earlier (so he says.. Eyeball Roller )
3. He immediately realized the mistake and played a 'first responder' role in the incident
4. The woman (and her husband) are not pressing charges. Does this even play a role whether the state files charges or not??
It doesn't discount the fact that he is a total idiot for taking what was essentially a 'sound shot'. He clearly was not sure of his target, what was beyond his target and clearly only aimed in the general area of what he hoped would produce a killing shot. Based on these details, it does seem like an accident. A REAL F'ING DUMB ONE!!!!, but at the end of the day, still an accident.
I admittedly do not know for sure if you can be charged for accidently shooting someone. What would the charge be????

Connnecticut has a Negligent Hunting law. 1st through 4th degree. Not sure about Massachusetts but I would think you guys have something similar. This sounds more like negligence than an accident to me but that is only what we are hearing from the media who are usually always wrong.

Cant beleive it, if he wasnt a COP he would be in jail. Such BS. How can anyone shoot someone else, i dont get it. its rule # 1 with shooting a gun.. identify your target. Gives all of us hunters a bad name. Hope he gets his someday. Maybe a criminal will accidently shoot him..

The fact is it was dark and he was in the woods. He couldn't identify his target, he should have never pulled the trigger. Couldn't he hear the dog licenses and rabie tags gingling that the two dogs were wearing? He has special weapon training that makes him a professional. He should be held accountable for his actions. Here is another joke, I'm a professional driver CDL class A and as of Jan 3rd 2012 if I'm caught talking on my hand held cell phone while driving it's a 2700 dollar fine. During the course of my day I see local police and state troopers driving around with there cell phones to there ears. They are professional drivers as well as law enforcement officers as far as I'm concerned and they don't get fined for there actions. Why don't they just fine everyone on a cell phone while driving 2700 bucks?

The trooper should loose his hunting privileges for at least 5 years and be handed down a nice hefty fine along with making him responsible for medical treatments the victim receives.
